Freshmushrooms Ltd was established 25 years ago by its current managing director Hans Grootewal.
Together with daughter Astrid, the company has grown in those years to become the market leader in the Netherlands. Meanwhile, 3 generations are working in the company.
Fresh Mushrooms Ltd. is since 25 years the market leader in the field of cultivating fresh psilocybin mushrooms.
The magic mushroom is a collective name for psilocybin and psilocybin containing mushrooms that have a hallucinogenic effect on humans because of these substances. For centuries, the magic mushroom has been used for spiritual purposes, both inside and outside of Europe.
This spiritual use is particularly aimed at gaining psychological, philosophical and spiritual insights.
Since the seventies the magic mushroom has also gained popularity in Europe as a regular dietary supplement. Lovers of the magic mushroom use them because of the visual effects and the changes in mood. The effects are mainly positive.
A study by the American researcher Dr Griffiths (2006), for example, showed that in the majority of users (approximately 80%) a feeling of wellbeing and joy of life had increased as a result of use. In addition, about two-thirds of the subjects in Dr Griffiths' study qualified their use as one of the top five most meaningful spiritual experiences.
Since the mid-nineties, a number of studies on the effects and possible harmful effects of the use of magic mushrooms have been carried out in the Netherlands, commissioned by the Minister of Health, Welfare and Sport and carried out by the Coordination Point for Assessment and Monitoring of New Drugs (CAM). Every time, these studies showed that the magic mushroom is hardly toxic in normal doses, and that there is no physical dependency. Nor does normal use of the mushroom lead to physical damage.
In short, the magic mushroom,
is non-toxic, non-addictive and not harmful.
For the Minister of Health, Welfare and Sport, there was for years no reason to ban the use of fresh mushrooms in the Netherlands. Furthermore, in 2002 the Supreme Court ruled that fresh mushrooms do not fall under the scope of the Dutch Opium Act. With this ruling, it was definitively clear that the fresh mushroom was not only a harmless and safe drug, but also a perfectly legal drug.
After years of relative calm on the subject of magic mushrooms, on 24 March 2007, a 17-year-old French girl committed suicide in Amsterdam by jumping from the famous science museum Nemo. This very tragic event caused great social unrest and indignation, especially when various media made a direct link between the use of magic mushrooms by the girl and the suicide.
When it became clear a few weeks later that the girl had been suffering from schizophrenia for a long time, had made several suicide attempts and was almost certainly a polydrug user, the damage was done. In the political frenzy and outrage of the moment, a majority in the Dutch Parliament urged the Minister of Health to ban fresh mushrooms.
The various studies that the Minister subsequently commissioned from CAM, however, again showed that the use of fresh mushrooms poses no risk to the individual health of the user, no risk of crime, no risk of disturbance of public order and only a slight risk to public health.
In view of these conclusions, the Minister could not legally place the fresh mushrooms under the scope of the Opium Act, because the Opium Act only prohibits substances that can lead to damage to health and damage to society when used by humans. The investigations showed that the magic mushroom did not cause any such damage.
In order to place fresh mushrooms under the scope of the Opium Act, the Minister of Health, Welfare and Sport, contrary to the research results of the CAM and contrary to the advice of various experts, made an independent risk assessment in which he stated that the use of fresh mushrooms leads to unpredictable behaviour and that this unpredictable behaviour poses a great danger to the individual health of the user and to society.
Subsequently, the Minister has prohibited the use of fresh mushrooms as of December 1, 2008.
Fresh Mushrooms, together with the Dutch interest group for the Smartshop sector, VLOS, has made an extreme effort through summary proceedings and an emergency appeal to revoke the ban on paddo's through the courts, because they consider the actions of the Minister to be in clear violation of the requirements of care that the Dutch Opium Act imposes on the prohibition of substances.
However, the interim relief judge of the District Court and the counsels of the Court of Appeal ruled that the Minister of Health, Welfare and Sport has a very wide discretion when considering whether or not to bring substances within the scope of the Opium Act. According to the district court and the court of appeal, the minister even has so much freedom that he can, with a brief explanation, deviate completely from the conclusions and recommendations of the experts he has engaged.
As a result, Fresh Mushrooms' business activities became punishable from one moment to the next and Fresh Mushrooms had no choice but to cease all its business activities as of 1 December 2008.
Fresh Mushrooms had no choice but to resign itself to the paddoo ban and subsequently started compensation proceedings against the State of the Netherlands because it considered it unjust and unlawful that the damage it had suffered as a result of the paddoo ban and still suffers daily was not compensated by the State in any way.
In the compensation proceedings of Fresh Mushrooms, the State took the position that the damage suffered by Fresh Mushrooms as a result of the mushroom ban falls within the normal business risk. The State Attorney on behalf of the Minister of VWS also argued that Fresh Mushrooms could have switched its business activities to a drug comparable to the magic mushroom, such as the truffle.
The State Attorney was referring to the sclerotia of the psilocybe tampanensis, better known as the hallucinogenic truffle. These truffles have a completely comparable hallucinogenic effect as fresh magic mushrooms, but the Minister has not brought these truffles under the scope of the ban on magic mushrooms.
The court subsequently found in favor of the State and ruled that it cannot be seen why Fresh Mushrooms could not diversify its business in such a way (could produce and sell multiple products) that it would have been less vulnerable when the paddoo ban was introduced. The claim for compensation was denied among other things on this ground.
Fresh Mushrooms has decided to abide by the decision of the court and to follow the advice of the Minister of VWS and the court. Fresh Mushrooms has therefore, more than two and a half years after the entry into force of the ban, switched its business activities to the legal cultivation and sale of hallucinogenic truffles.
And then we had no choice but to become the largest and best Magic Truffle farm in the Netherlands.

Since the mushroom ban came into force, the owner Hans Grootewal, mycologist and owner of Fresh Mushrooms Ltd has dedicated himself to the cultivation and breeding of Magic Truffles with the aim of developing a quality product that surpasses the mushroom.
